What Are U.S. Import Duties and How Are They Calculated?

When goods enter the United States, U.S. Customs and Border Protection (CBP) assesses duties based on the Harmonized Tariff Schedule of the United States (HTSUS). The duty rate depends on the product's 10-digit HTS code, the country of origin, and the customs value of the shipment.

The customs value is generally based on the transaction value — the price actually paid for the goods — plus certain additions such as packing costs, selling commissions, and royalties. Under CIF (Cost, Insurance, Freight) incoterms, freight and insurance are included in the dutiable value. Under FOB terms, only the value at the port of export is used. CBP uses the customs value to calculate the duty amount owed.
Section 301 tariffs are additional duties imposed on goods of Chinese origin under the Trade Act of 1974. They were introduced in 2018-2019 and apply to thousands of HTS codes for goods manufactured in China. The additional rate ranges from 7.5% to 25% depending on the product list (List 1, 2, 3, or 4A). These tariffs are applied on top of the regular MFN duty rate. If your goods originate from any country other than China, Section 301 tariffs do not apply.
The MPF is a CBP user fee charged on most formal entries (shipments valued over $2,500). It is calculated at 0.3464% of the entered value, with a minimum charge of $31.67 and a maximum of $614.35 per entry regardless of shipment value. The MPF applies to most commercial imports and is in addition to any duties assessed.
Shipments valued at $800 or less may qualify for the Section 321 de minimis exemption, meaning they can enter the U.S. duty-free and without formal entry. However, this exemption has been subject to significant policy changes and proposed restrictions, particularly for goods from China. Always verify current de minimis rules before relying on this exemption for your import strategy.
